Domestic Buyers:
- We accept Pay Pal, Visa, Mastercard, Amex and Discover. We also accept Check, money order and wire transfer.
Checks will delay shipping aprox. 7 days.
- We typically only ship to the address that matches the credit card billing for fraud prevention.
- On certain larger ticket items we may require that you fax us written/signed authorization to charge your credit card.

If package is not picked up or delivery taken from fedex our round trip shipping costs with Fedex will be deducted from your refund amount.

Upscaletime.com Limited Warranty
Upscaletime.com provides warranty coverage of generally for one year from the date of purchase on all watches unless otherwise noted. Some watches we sell may have manufactures warranty longer than one year(usually two years). Our warranty covers the watch movement for the time period stated and excludes: watch case, watch bracelet, straps, crown/stem, crystal/glass, finishes, damage caused by excessive wear and tear and/or physical/accidental abuse, and damage resulting from wear under conditions exceeding the watch manufacturer's water resistance limitations. All shipping and handling costs in connection with warranty service are the responsibility of the customer. This warranty is valid only at Upscaletime.com unless watch has MFG's warranty it can b sent directly to the MFG's service center or authorized agent. Improper repair or warranty service performed by someone other than Upscaletime.com will void this warranty. Upscaletime.com DISCLAIMS ANY LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES FOR BREACH OF WRITTEN OR IMPLIED WARRANTY OF THIS WATCH, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

Subject to the following arbitration provision these terms and conditions shall be governed by, construed and interpreted according to the laws of the Commonwealth of Virginia, and you and UpscaleTime.com (the 'Parties') agree to and consent to the exclusive jurisdiction and venue of the courts in Campbell County, Virginia. Should a dispute arise between the Parties which cannot be resolved by the Parties in good faith negotiations, both Parties agree to submit such dispute to arbitration in Campbell County, Virginia, before a single arbitrator familiar with the Uniform Commercial Code using the Commercial Rules of the American Arbitration Association, with the following modifications to be enforced by the arbitrator consistent with Virginia law: (a) any such arbitration proceeding shall be confidential as to the existence, content, and results of the arbitration; (b) depositions shall not exceed two (2) per party and all must be completed within a single day; (c) document requests are limited to no more than ten (10) clearly identified categories of documents which must be provided to the requesting party within five (5) business days of the request; (d) each party shall have no more than eight (8) hours to present its position; and (e) the entire hearing shall last no longer than three (3) business days. The award, if any, shall be rendered no more than thirty (30) days following the end of the proceeding. Judgment upon the award rendered by the arbitrator may be entered by any court having jurisdiction. Both Parties expressly agree that any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. Each party shall bear its own attorneys' fees and costs in connection with the proceedings and shall share equally the fees and expenses of the arbitrator.

No insurance company(including USPS) that we (Upscale Time LLC) can find will insure a package containing a watch to Russia, Ukraine or any Russian territory. The only courier that will ship to Russia, Ukraine or any Russian territory watches to individuals with limited restrictions is USPS Express EMS. We ship all packages to Russia, Ukraine or any Russian territory by USPS EMS express. From our experience the rate of package loss, theft by customs agents, problems with customs clearance and other issues is higher when using USPS express EMS to Russia, Ukraine or any Russian territory than when we ship using other couriers to others countries. For the reasons outlined above the purchase is 100% at your own risk(the buyer). This means once you pay us for the product by PayPal, Credit card, Wire transfer or Western Union we will package the product and ship to the address provided by the buyer. We will retain proof of shipment with USPS express. After given to USPS our (the seller) liability with the sale will end. If the package is lost, stolen by customs agent, courier or any other scenario involving the buyer not receiving the product you agree not to hold Upscaletime.com responsible in any manner. This includes but not limited to credit card Chargeback's or PayPal disputes. If shipping to Russia, Ukraine or any Russian territory you understand and agree to the terms of purchase outlined above.
